For those that have been following the defamation lawsuit between Tom Scholz and the Boston Herald, there's been another setback, according to an article by the Boston Herald (no other sources available at time of writing this article).

Susan Stenger, one of Tom's lawyers, has been ordered to pay over $17,000 in attorney fees to the Herald for withholding over 19,000 pages of evidence, which a judge ordered Tom to produce in summer of 2010. It appears Tom did produce the documents, but the lawyer did not hand them over to the Herald's lawyers until October of this year. Discovery Master Thomas Maffei determined that the evidence was not intentionally withheld, saying "I find no basis to conclude that the late production of the nine boxes was intentional on Ms. Stenger's part, that she purposely violated a court order, or that she withheld the boxes because Mr. Scholz directed her to do so," Maffei wrote in his Dec. 23 order. "The failure was a mistake, plain and simple."
